Termination Policy

1. General provisions

1.1. This Termination Policy (“Policy”) is established by Empresex.io, operated by Cloudpeak Systems s.r.o. (registration number 21721769), a company duly registered under the laws of the Czech Republic, with its principal place of business at Na strži 1702/65, Nusle, 140 00 Praha 4, Prague, Czech Republic (“Company”).

1.2. This Policy outlines the circumstances and procedures under which user accounts and access to the Company’s services may be terminated or suspended, either by the Company or at the user’s request.

2. Grounds for termination

2.1. The Company reserves the right to terminate or restrict access to the Services under the following circumstances:

Violation of the Company’s Terms and Conditions, Privacy Policy, Acceptable Use Policy, or any other applicable policies.
Failure to comply with Know Your Customer (KYC) or Anti-Money Laundering (AML) requirements.
Engagement in fraudulent, illicit, deceptive, or otherwise prohibited or high-risk activities, including but not limited to money laundering, terrorist financing, or activities involving sanctioned individuals, entities, or jurisdictions.
Provision of false, inaccurate, or misleading information during the account registration or verification process.
Unauthorized use of the Services or access to accounts not lawfully owned by the user.
Attempting to gain unauthorized access to the Company’s systems, data, or other users’ accounts.
Use of automated tools, bots, or scripts to access or interact with the Services without the Company’s prior written consent.
Actions that compromise or attempt to compromise the security, integrity, or functionality of the platform.
Failure to respond to the Company’s requests for information, documentation, or clarification within a reasonable period.
Prolonged inactivity of the account, as defined in the Company’s internal policies.
Any conduct that, in the Company’s reasonable opinion, may harm its reputation, security, or the interests of other users.
Involvement in activities that contradict the Company’s internal risk management policies or business practices.
Use of digital wallets or addresses identified as high-risk or associated with illicit activities, as determined by blockchain analytics and risk scoring tools.
Transferring funds to or from jurisdictions that are prohibited or restricted by the Company due to legal, regulatory, or risk management considerations.
Engaging in transactions or activities that raise concerns related to market manipulation, insider trading, or other forms of financial misconduct.
Any other reason deemed necessary by the Company to protect its legal, regulatory, or business interests.

3. Effects of termination

3.1. Upon termination, the user shall immediately lose all access to the Services, including any associated functionalities, assets, or data.

3.2. The Company reserves the right to withhold, freeze, or forfeit any funds or digital assets in the user’s account if such action is required to comply with legal, regulatory, or contractual obligations, or as a result of an ongoing investigation.

3.3. Any pending transactions or withdrawals may be canceled, reversed, or delayed at the Company’s sole discretion.

3.4. The Company is not liable for any losses or damages resulting from the termination or suspension of access to the Services.

4. User-initiated termination

4.1. A user may request account termination by submitting a written request to the Company via the designated support channels ([email protected]).

4.2. The user must withdraw all remaining funds or digital assets from their account before submitting a termination request, unless otherwise directed by the Company due to ongoing investigations or legal obligations. The Company may require additional verification to process the withdrawal and closure.

4.3. Once the account is terminated, all user data will be handled in accordance with the Company’s Privacy Policy and applicable data protection laws.

5. Suspension and investigation

5.1. The Company reserves the right to temporarily suspend a user’s account without prior notice if suspicious, irregular, or potentially illegal activity is detected.

5.2. During the suspension period, the Company may conduct an internal investigation and request additional documentation or clarification from the user. Access to funds or services may be restricted until the investigation is complete.

5.3. If the investigation confirms a violation of this Policy or applicable laws, the Company may proceed with permanent termination and take any further action required by law.

5.4. The Company will make reasonable efforts to notify the user in writing (including by email or through the Platform) of any decision to terminate, restrict, or suspend access to the Services, stating the reason for such action, unless prohibited by law or regulatory requirements. The notification will include information on the effective date of the action and, where applicable, instructions for withdrawal of any remaining funds or assets. In urgent cases involving fraud, security threats, or legal obligations, the Company may implement restrictions or termination without prior notice, but will inform the user as soon as reasonably practicable thereafter.

6. Right to Appeal

If a user believes that the termination, restriction, or suspension of their account was made in error, they may submit a written appeal to the Company at [email protected] within thirty (30) days of receiving the notification. The Company will review the appeal in good faith and provide a written response within a reasonable period. The decision of the Company following the appeal process shall be final.
